Welcome to Loyalty Graphics (“Loyalty Graphics,” “we,” “us,” or “our”), located at PO Box 2102, Del Mar, CA 92014. Throughout this site, the terms “we”, “us”, and “our” refer to Loyalty Graphics. These Terms and Conditions govern your use of our website https://loyalty.graphics/ and any purchases you make from us. By accessing or using the site, you agree to these Terms. If you disagree, please do not use the site. These Terms may be updated from time to time without prior notice. Continued use of the site after any changes constitutes acceptance of the revised Terms. Your submission of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You must be at least eighteen years old to use this site. By using the site, you represent that you meet these age requirements. Products may also be purchased by individuals under 18 with the involvement and consent of a parent or legal guardian. Our products are not designed or marketed for children under the age of 13. You agree not to misuse the site, attempt to hack, or use it for unlawful purposes. If you create an account on our site, you are responsible for maintaining the confidentiality of your account information and for all activity under your account. We reserve the right to terminate accounts at our discretion.

All content, designs, logos, product images, and text on this site are owned by Loyalty Graphics. You may not reproduce, copy, sell, or distribute our materials without written permission. If you submit content such as reviews, photos, or testimonials, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute that content for marketing and promotional purposes. All content, designs, logos, product images, and text on this site are the property of Loyalty Graphics and protected under applicable intellectual property laws.

Our site may contain links to third-party websites. We are not responsible for the content, policies, or practices of those websites.

By placing an order, you agree that all information provided (billing, shipping, etc.) is accurate. Prices are listed in U.S. dollars unless stated otherwise. We reserve the right to refuse or cancel orders at our discretion, including suspected fraud. Promotions, sales, and discount codes may be subject to restrictions and can be changed or canceled at any time.

Orders are processed within 1–4 business days after payment is received, but may vary. Shipping times vary depending on your location and the carrier. You will receive a confirmation email with tracking information once your order has shipped. Risk of loss transfers to the customer once the order has been delivered to the carrier. From time to time, certain products may be offered as pre-orders or backorders. If you purchase one of these items, payment will be collected at checkout and the estimated shipping date will be clearly stated on the product page. Please note that pre-order and backorder shipping dates are estimates only and may change due to manufacturing or supply chain delays. Orders containing pre-order/backorder items will ship once all items are available unless otherwise specified.

Shipping costs are calculated at checkout unless otherwise stated. Customers are responsible for providing an accurate shipping address at checkout. If a package is returned to us due to an incorrect address, the customer will be responsible for paying re-shipping fees.

For international orders, buyers are responsible for any customs duties, taxes, or import fees required by their country. We are not responsible for delays caused by customs, carriers, weather, or other circumstances outside of our control.

Once the carrier marks a package as delivered, we are not responsible for lost or stolen packages. Customers should contact the carrier directly for assistance regarding lost or delayed deliveries.

All sales are final, including but not limited to apparel, accessories, gift cards, digital downloads, clearance items, and promotional products. These items are non-returnable and non-refundable under all circumstances. The only exceptions are size exchanges (wrong size ordered; see policy below) and damaged or defective items (may qualify for replacement or store credit at our discretion; see policy below).

We do not allow cancellations or refunds once an order has been placed. However, we do allow size exchanges if the wrong size was ordered. Requests must be made within 7 days of delivery by emailing [email protected]. Customers are responsible for return shipping costs. Items must be returned in unused, unworn condition. Exchanges are limited to the same product in a different size and are subject to availability. Exchanges cannot be made for a different style, color, or design.

If your item arrives damaged or defective, you must contact us within 7 days of delivery at [email protected]. Include your order number and clear photos of the issue. Once reviewed, we may provide a replacement or store credit at our discretion. Customers may be required to return the defective item before a replacement is issued.

Payments are processed securely through trusted third-party providers (e.g., Stripe, PayPal) who are PCI DSS compliant. We do not store full credit card numbers; all transactions are handled securely by these providers.

We do not guarantee that the site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use the site at your own risk.

We are not liable for any indirect, incidental, or consequential damages arising from your use of the site or our products. Our total potential liability to you for any claim will not exceed the amount you paid for the product. Nothing in these Terms and Conditions shall exclude or limit any liability which cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or any consumer rights that may not be waived under law.

You agree to indemnify, defend, and hold harmless Loyalty Graphics and its affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your misuse of the site or violation of these Terms.

Products are for personal use only. Loyalty Graphics is not responsible for damage caused by improper use or care. Clothing products are intended for general wear only and are not designed or certified for protective use. Sizes and colors may vary slightly from product images due to screen settings, manufacturing processes, or dye lots.

Affiliate and Referral Program: If we offer an affiliate, referral, or ambassador program, participation will be subject to the specific program rules and requirements provided at the time of enrollment. Loyalty Graphics reserves the right to approve, modify, or terminate participation at our discretion. Rewards, commissions, or discounts are not guaranteed and may be subject to verification. Abuse, fraudulent activity, or violation of these Terms may result in disqualification from the program without notice.

Wholesale and Reseller Terms: If you purchase products from Loyalty Graphics for wholesale or resale purposes, you must first obtain written approval from us. Wholesale orders may be subject to minimum purchase quantities, separate pricing, and additional terms that will be provided upon acceptance into our wholesale program. Unauthorized resale of our products is prohibited and may result in cancellation of orders or termination of your account.

Loyalty Graphics is not responsible for delays or inability to fulfill orders due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or carrier delays.

We may offer affiliate, referral, or promotional programs. Participation is at our discretion, and we reserve the right to modify or cancel them at any time. Must be 18+ and a resident of a valid shipping country. First-time customer rewards are not automatic; they only apply when specifically offered as part of a referral or promotional program. Discounts cannot be combined with other promotions unless explicitly stated. Abuse, fake accounts, or other attempts to exploit the promotion may result in disqualification. Contact information of referred friends will only be used to notify them and will not be sold or shared.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from the use of this site or the purchase of our products will first be attempted to be resolved informally. If not resolved, disputes may be settled through binding arbitration in San Diego County, California. These Terms are written in English. If translated into another language, the English version shall control in the event of any conflict. These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Loyalty Graphics and supersede any prior agreements.
